Who you are dealing with
This site and these apps are operated by Search Ventures Pty Ltd (ACN 639 906 353), trading as Practice Test App.
The app license
Apps downloaded from the App Store are licensed to you under Apple's standard End User License Agreement, which you can read at apple.com/legal/internet-services/itunes/dev/stdeula. Where that license and these terms overlap, the Apple license governs your use of the app itself.
Not official, and not endorsed
These are independent practice apps. None of them is affiliated with, authorized by, endorsed by, or in any way officially connected with the body that sets or administers the exam it prepares you for. All trademarks belong to their respective owners, and are used only to describe which exam an app prepares you for.
Study material, not advice
The questions and explanations are study material. They are not professional, legal, medical, aviation or career advice, and they are not a substitute for the official study guides and regulations published for each exam. Always check the current official source before acting on anything you read here.
No guarantee of a result
We do not guarantee that using these apps will result in a passing score, a particular score, eligibility for a role, or any other outcome. Exam content, scoring and standards change, and how well you do depends on many things outside our control.
Subscriptions
Some features require a paid subscription, purchased and billed through your Apple account. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. You manage and cancel a subscription in your App Store account settings, not through us, and refunds are handled by Apple under their policies.
Your rights under Australian Consumer Law
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law.
To the extent the law allows, and except for those non-excludable guarantees, our liability arising out of the apps or this site is limited to resupplying the service or paying the cost of resupply, and we are not liable for indirect or consequential loss.
The questions are ours
The question banks, explanations, references and the apps themselves are our intellectual property. A subscription buys you the right to study with them, personally. It does not transfer ownership of anything.
So: do not copy, republish, resell or redistribute the questions or explanations, do not scrape them or extract them in bulk by any automated means, and do not use them to build or train a competing product. Exam names and the names of the bodies that administer them belong to their owners and are used here only to say which exam an app prepares you for.
Using the apps and this site
Use the apps for your own study. Do not attempt to gain unauthorized access to any part of the service, disrupt it for other people, submit unlawful or deliberately false content through the support form, or misrepresent yourself as connected to us. We may suspend access that is being used to do any of those things.
If your use of the apps causes a claim
If someone brings a claim against us because of how you used the apps or this site, or because you broke these terms, you agree to cover our reasonable costs in dealing with it. This does not apply to the extent the claim arises from something we did, and nothing here affects the rights described under Australian Consumer Law above.
If part of these terms does not hold
If any part of these terms turns out to be unenforceable, that part is read down as far as needed to make it enforceable, or removed if it cannot be. The rest of the terms continue to apply. Removing one clause does not remove the others.
What makes up the agreement
These terms, together with our privacy policy and the Apple licence linked above, are the whole agreement between you and us about the apps and this site. They replace anything said earlier.
We may update these terms. The date at the top of this page changes when we do, and continuing to use the apps after that means the updated terms apply. If a change is significant, we will say so in the App Store release notes rather than relying on you to notice this page.
Governing law
These terms are governed by the laws of Queensland, Australia. Disputes are subject to the courts of that state, without limiting any right you have to bring a claim where the law otherwise permits.
